1. general information

1. The scope of these terms and conditions (the "agreement") sets out the terms of service of the online platform of Feehand Co., Ltd. (the "company"), an online platform provider (the "service") that facilitates the linking of importers and exporters (the "user") with the export importer's agent companies (the "users"). For the search and commissioning of international freight operations agents.
Users, including customers and export importer's agent companies ("users") shall abide by this agreement throughout the service period and agree and acknowledge that the company is the platform provider and is not responsible for any transactions, operations or contractual fulfilment between the user and the exporting agent.

2. By accepting the terms of access to or use the services, including registration of account on the platform, you agree to be bound by this agreement. You acknowledge that you have read, understood and agreed to the terms and conditions set forth. Without your consent, you are not entitled to access or use the services of the company.

2. Registration and account

1. Account Application: *** Users must register the account with accurate and complete information, such as name, address, email, and other current relevant information, as specified in the application form.

2. Retention of account information : *** user is responsible for maintaining his / her username and password. If any unauthorized use of the account is found, notify the company immediately.

3. Right to suspend account : *** the company reserves the right to suspend or terminate the account of a user who violates these terms.

3 . Service

1. Sourcing agent for import and export management : *** our service is to supply import and export agent and connect between buyer and seller through online platform.

2. Restrictions on services : *** the company does not accept illegal, prohibited or unregulated products or products outside the scope specified on the company's website.

3. Processing time : *** the processing time depends on factors such as availability, type of goods, or requirements in the country of origin and destination.

4. Review and Control of Quotations: The Company reserves the right, at its sole discretion, to review, modify, suspend, reject, or remove any quotation, proposal, business proposal, or related information submitted through the Platform that is deemed inconsistent with the Platform's policies, guidelines, eligibility requirements, or these Terms and Conditions.

The Company further reserves the right to restrict, suspend, revoke, or terminate quotation privileges for any user who is not authorized or approved by the Company to submit quotations through the Platform.

Any such determination and action shall be made at the sole discretion of the Company.

4. Service charge and payment

1. Fee structure : ***we charge a service fee based on the quotation of export importer's agent. The fee will be determined by the company.

2. Informing the service fee : *** the company will inform the user of all service fees in advance before agreeing to the service and may change according to the company's policy.

3. Payment : *** users must pay by the method specified in the platform, such as credit card, bank transfer, or online payment service. - payment must be made within the specified time limit. If the user fails to make payment within the specified time limit due to delay or failure to pay the service fee of the user, the company reserves the right to temporarily or permanently cancel the service and take legal action.

4. Modification of service charge : *** the company reserves the right to update all service charges. In case of any change of product information from the user specified in the platform, the user will be notified in advance before the adjustment.

5. Commission

The payment of monthly commissions is processed automatically after the company has completed the receipt payment of the user's services. The company will collect the sales or transactions completed each month and transfer the money within the 5th of the next month.

6. User responsibility

1. Product information : * * the user is obliged to specify the information of the product sent to be correct, complete and true, including the following details.

• type of product.
• net weight and gross weight
• size and volume of the goods
• number of units or quantity of goods
• current and accurate delivery or delivery address

Users are prohibited from providing false, distorted or concealed information that may affect the transportation, service charges or compliance with applicable laws. In case of product information being identified incorrectly, the company reserves the right to refuse the service, charge additional charges or take legal action as appropriate.
Users must specify the product information accurately and completely, including the type of product, weight, size and quantity, without any falsehood.

2. Compliance with law : * * the user is responsible for complying with relevant laws, requirements and regulations of the country of origin, country of destination, and country related to the shipment of goods such as customs law, control of prohibited goods or goods that require a license.

3. Damage to goods : * * * the company is not responsible for damages to the goods caused by improper packaging by the user or the process of transportation from the export importer's agent companies.

4. Additional documents : * * * the user is obliged to prepare the relevant documents for the company's request in order to ensure the correct and efficient calculation of the service charges and the transportation operations. The company reserves the right to request additional documents related to the delivery from the user, which may include but not limited to :

• bill of Lading.
• air waybill.
• tally sheet.
• other documents related to transportation and calculation of service charges.

When receiving a request from the company, the user must deliver the requested documents to us within 3 days from the date of receipt of the notice. If the documents cannot be delivered within the specified time, the user must notify us in writing as soon as possible. If the user neglects or fails to comply with the above terms, the company reserves the right to suspend the service or take necessary steps in accordance with the law to comply with the terms of service.

7. Company responsibility

1. Data accuracy : * * * the company shall not be liable for any damages caused by the use of the system, incorrect data input or discrepancies of data provided by the user or the export importer's agent companies.

2. Limitation of liability : * *

• the company has no obligation to guarantee the success of any transactions or operations of the export importer's agent companies.
• the company is not responsible for any damages, losses or expenses caused by force Majeure such as natural disaster, accident, political incident, airline delay, customs issue or legal restriction.
• the company is not responsible for any disputes or claims arising between the user and the export importer's agent companies in all cases.
• we are not responsible for any damage, loss or deterioration of the goods caused by improper packaging by the user or occurred during the process of transportation of the relevant agency.
• The company shall not be held responsible for any misuse of information by the parties involved. Customers and freight forwarders are solely responsible for their data usage under the agreed terms.

8. End of use

1. you can cancel your account at any time through the system.

2. we reserve the right to suspend or terminate your account if it is found to be in violation of the terms.

9. Cancellation and change of service

1. User cancellation : * * * user can cancel the service under the conditions set out in the cancellation policy.

2. Cancellation by the company : * * * the company reserves the right to cancel the service if the product information does not conform to the conditions or is illegal.

3. Changes to the service : * * * the company can adjust the service, fees or conditions without notifying the user in advance.

10. Data Sharing Between Customers and Freight Forwarders

Connection of Personal Data and Related Documents
1. During the connection process between customers and freight forwarders via www.feehand.com, personal data and related documents will be shared only between the selected parties.

2. The shared data may include name, phone number, email, company address, quotation, invoice, packing list, and other relevant logistics documents.

11. Personal information protection

1. FEEHAND Co., Ltd. ensures compliance with the Personal Data Protection Act B.E. 2562 (PDPA) of Thailand and other relevant data protection laws.

2. By using the platform, users acknowledge and consent to the sharing of such data exclusively for business transactions between selected parties.

3. no unauthorized third party information may be disclosed by the user.

12. Amendment of terms

1. The company reserves the right to modify or update these terms at any time without prior notice. Changes will take effect immediately upon publication on the platform.

2. by continuing to use the service after the change, you agree to the updated terms.

13. Applicable law

1. These terms of use are governed by the laws of Thailand and the country of destination. If any dispute arises, a petition shall be made to a court of jurisdiction in Thailand or the jurisdiction of the courts in that country.

2. Late Payment Prevention : The company reserves the right to take legal action against users who do not pay the service fee according to the conditions set forth by the company, including charging interest or fine in accordance with the relevant laws.

3. Legal action : In the event of a dispute or breach of the terms, the company has the right to prosecute in court to protect its rights and interests, including claims for damages or legal fees.
